A hearing to compel Jackie to submit phone and communication records as part of an ongoing lawsuit filed by Assoc. Dean of Students Nicole Eramo has been transferred from Alexandria to Charlottesville.
Eramo filed a $7.5 million lawsuit against Rolling Stone, Sabrina Rubin Erdely and Wenner Media last spring following the retraction of the Nov. 19 Rolling Stone article, “A Rape on Campus,” detailing an alleged violent gang rape at the University.
Eramo filed the initial lawsuit in Circuit Court in the City of Charlottesville before it was transferred to the U.S. District Court for the Western District of Virginia, still in Charlottesville, later that month. By November, the lawsuit was moved to the U.S. District Court for the Eastern District of Virginia, sending it to Alexandria.
Eramo and her lawyers initially submitted a subpoena to gather Jackie’s phone and communication in July. After Jackie objected in October, a hearing was scheduled for Nov. 20 and was then postponed to take place in Alexandria on Dec. 4.
"’Jackie’ objects to Plaintiff's Requests to the extent they require ‘Jackie’ to produce documents or information that may violate her dignity and/or privacy interests,” Jackie’s objection read.
The rest of the case will be tried in Charlottesville within the U.S. District Court for the Eastern District of Virginia.
