The grand jury hearing for University student Aaron Joshua Robinson, who is charged with one count of malicious wounding for the April 28 non-fatal shooting of former University football player Jamaine Winborne, has been postponed until August 2.
The hearing, originally scheduled for June 7, was delayed at the request of the defense counsel, said Tony Tuthill, Albemarle County's Commonwealth Attorney office associate.
The shooting, following an altercation during a party at the Sigma Nu fraternity house, took place at Hench Dormitory in the Faulkner Residence Area on April 28.
Robinson pled self-defense at the preliminary hearing held May 27, Robinson's attorney J. Lloyd Snook III said.
Snook said Winborne choked Robinson half an hour before the shooting and that when Robinson shot Winborne he was acting in self-defense.
"Aaron shot down, at Mr. Winborne's leg," Snook said. "If he wanted to kill him he could have killed him."
A preliminary hearing is standard for all defendants arrested on a warrant, Snook said.
Winborne admitted to choking Robinson earlier in the night but testified that he was running away from Robinson at the time he was shot.
After an indictment, a trial will probably not be scheduled until January, Snook said.
"Since most of those involved are on football teams, whether it be here at U.Va. or on professional teams, it just makes sense to have the trial after the football seasons are over," Snook said.
Winborne recently signed a three-year contract with the New York Giants.
Two University football players, fourth year Marques Hagans and third year Brandon Lee, were found not guilty of disorderly conduct according to case details obtained from the Ablemarle County District Court Web site.
The Daily Progress reported that Albemarle County Judge Robert H. Downer Jr. ruled that the prosecution failed to prove the charges.
Hagans is expected to be the starting quarterback for the Cavaliers in the fall.
Third year Kenneth Tynes also was found not guilty on vandalism charges at his hearing on May 21. Tynes allegedly threw a chair through a window following the shooting.
Winborne could not be reached for comment.
